🚨 ET Justice in the Dark: My Open Letter Challenging the Lady Chief Justice 🚨 I'm Alison McDermott and I speak for many who believe that a justice system without a court record is patently unfair and absurd. Yet this is the nonsense/scandal that exists in the ET system. Separately, multiple women and I have filed serious complaints against Employment Judge Lancaster. Despite BBC News coverage, he still presides. Why? No official court record exists and he is refusing to release his notes. https://lnkd.in/etCwCHCN I've just written to Dame Carr, the Lady Chief Justice, demanding answers: the extract is below. Dear Mr McGuiness/Dame Carr, I write to express my profound dissatisfaction with your response of 5 July 2024. Your conspicuous refusal to address the critical question of whether our ET hearings - conducted without an official court record and denied access to the judge's notes – were fair is not only deeply concerning but also increasingly suspect. I reiterate that recent case law and Presidential Guidance clearly support our position [i.e. that the judge's notes are the official record, where no other transcript exists]. I now request your direct, unequivocal response to these three crucial questions: 1. Does Dame Carr maintain her decision of 24 June 2024 that judge's notes do not constitute the official record, despite this contradicting both Presidential Guidance and Appellate court rulings? 2. If so, please explain on which lawful basis judge's notes are not accorded the status of an official record when no other record exists? 3. Finally, how can a trial be considered fair under these circumstances? This goes beyond procedural technicalities; it strikes at the heart of whether the conditions of our hearings breached fundamental human rights. If I do not receive a clear response from Dame Carr within 14 days, I will feel compelled to ask the press to investigate this matter and/or seek further legal advice. Yours sincerely, Alison McDermott 🔄 Share this post. Let's make it impossible to ignore. Together, we can force change. No more secrecy. No more injustice. No more absurdity in the ET Court of No Record. #BreakTheSilence #EmploymentTribunalScandal #DemandJustice #UKLaw
